RIGHTS OF WAY AND EASEMENTS
Rights of way and easements across Arkansas Riverbed lands are governed by 25 CFR 169 found at: http://www.access.gpo.gov/nara/cfr/waisidx_03/25cfr169_03.html.
The process of gaining easement requires an application, an appraisal of the subject property, and an environmental assessment.
The environmental regulations and requirements are set out in NEPA (National Environmental Policy Act). The regulations promulgating this act are found in 40 CFR 1500, found at:

Also, the Department of Interior, Bureau of Indian Affairs Departmental Manual, DM516 516 Chap. 10 gives guidelines for procurement of an easement.
